

THE PAYMENT OF BONUS ACT, 1965 APPLICABILITY OF THE ACT Bonus Act applies to every factory or establishment wherein 10 or more persons are employed. The Government may, after giving two months' notification in the Official Gazette, make the Act applicable to any factory or establishment employing less than ten. Once the Act applies it shall continuously remain in force irrespective of number of employees fall in number i.e. once covered always covered. ELIGIBILITY OF BONUS An employee will be entitled only when he has worked for 30 working days in that year. ELIGIBLE EMPLOYEES • Employees (other than an apprentice) drawing wages upto Rs.21000/- per month or less are entitled for bonus in the accounting year irrespective of his grade / designation i.e. manager / part-time / casual / seasonal employee etc. The bonus payable to eligible employees shall be Rs. 7000/- or minimum wages whichever is higher. Employees who are drawing salary of Rs. 21000/- or more or those who have worked for less than 30 days are not eligible to receive bonus under the Act.
